Victim Testifies Accused Had Always Threatened to Kill Her

During the trial for the alleged attempted murder, the victim (name withheld) testified that Yugo Sowe, the accused, had always threatened to kill her if she does not stop talking to him about land issues.

During the victim’s continuation of cross examination by Defense Counsel O.Susso, when she was told that considering the fact that she (victim) claimed to be having problems with the accused prior to the alleged incident, then she (victim) would agree that her natural instinct in drawing conclusions as to who allegedly chopped her legs would be the accused,to that she (victim) responded that the accused (Yugo) told her that if she does not let the land matter go, he (Yugo) would kill her Further testifying that the one she saw was the accused and that she would swear to the Quran anytime that the accused did that to her. Expressing that she can forgive him but he is the one.

When also asked if based on her alleged past experience with the accused, it is natural that she would have him as her prime suspect in the allegations of the offense with that she replied that she could take it that the accused is the one because any conversation that they had he would always tell her that he would kill her.

Counsel O.Susso asked the victim what is the distance between the compound that she is staying in and the one that the accused is staying in, she responded that the compounds are far from each other. When asked at what time she had gone to bed, she replied that she was not feeling well so she had her dinner after Magrib prayers then headed to bed.

The victim was asked at what time the alleged incident happened and to that she replied that it happened around 2am. Counsel O.Susso told the victim that she must have been in deep sleep given that she went to bed immediately after Magrib Prayers, she affirmed with a yes she was sleeping but when the accused hit her and she felt the pain she saw him. When asked to describe the layout of her room,she replied that it is a 2 bedroom with a parlor.

Counsel O.Susso asked the witness if it is also correct that she was in bed with her children when the incident happened to that she affirmatively replied with a yes she was in bed with her children. She was also asked how big is her bed to that she replied that where the accused met her, she had placed the mattress on the floor and that was where she was laying with her 2 children while the other bed was occupied by 2 of her boys.

Counsel O.Susso asked the victim if it is correct that she had earlier told the court that she was relocated to a bush by the accused to that she replied affirmatively with a yes. When also asked if she would agree that one of the attributes of a bush is darkness, she replied that it was dark but when the accused was coming there the place was cleared by her children. Counsel O.Susso further asked her it is correct that
Jalambang Touray Kunda does not have electricity supply to that she said where she is staying at does have electricity supply.

Counsel O.Susso told the victim that on the
3rd day of June 2024, she told the court that the garment worn by the accused was similar to turquoise color, blue and green color to that the victim replied that Exhibit P5 (turquoise color haftan that was tendered into evidence) was what the accused wore. Counsel further said to the victim if she is now telling the court that she was telling the truth on the 3rd of June when she said the garment worn by the accused was similar to turquoise color to that she replied affirmatively with a yes she said that.

Counsel also told the victim if it is correct that on the 4th of June, she told the court that she did not know what transpired between her and the police because she was unconscious to that she replied that when the police arrived and she was put in the vehicle to head to the hospital she did not know anything that was happening around her, but however when she was in her room she knew what she was saying.

Counsel O.Susso then put to the victim that on the 4th of June 2024 she told the court that she did not know what transpired between her and the police in her room because she was unconscious to that the victim replied that she did not say that, highlighting that what she said was when she was laying in her room she knew what was happening as she told them that the accused did this to her but on her way to Ndemban Clinic she did not know what was happening as she was unconscious.

Counsel O.Susso further asked the victim if it is correct that given that she was in a deep sleep when she was assaulted by the alleged assailant, it must have been frightening to that she replied that she was
not frightened because she knew it was the accused person as when he chopped her legs she asked him why he was trying to kill her. She further explained it was when the accused aimed for her neck that was when she raised her hand in order to defend her neck. She also told the court to look at what the accused did to her hand expressing that the accused ran off.

Counsel told the victim that if she is trying to tell the court, that she had no atom of fear when she was being stroke by the alleged assailant while she was sleeping to that she replied that she had fear because she had shouted to the extend that her son came knocking on her door. Highlighting that she asked her daughter who was in bed with her to open the door for her son to come in. Adding that she told her son if he had seen what his father has done to her. She stated that her son wanted to go out and call for help but she told him not to go because the accused thought that he has killed her already and if her son left to look for help the accused might come back.

The victim was told by the Counsel that given the fact that she was scared when she was stroked by the alleged assailant would she agree with him that all what she thought of at that stage was how to save her life rather than recognize the assailant to that she replied affirmatively with a yes she was thinking of how to save her life that was why she took her phone to call her neighbors instead of allowing her son to leave the room because the accused might going back to finish her off. Counsel also asked that victim if it is correct that the accused married a 2nd wife to that she replied with a yes but that was a long time ago. When asked if she would have loved to be the only wife of the accused to that she said no, she did not want to be the accused person’s only wife because when she was marrying the accused she met him with another wife.

Counsel told the victim that she was not happy when the accused wanted to give the land that she was occupying to his other wife to that she said that she was not
happy because where her co wife was had a fence, electricity and all, but the accused just wanted to spoil everything as all he does is to sell properties and waste money. Counsel O.Susso then put to the victim that
it was as a result of that anger and jealousy that she connived with her children to incriminate the accused to that the victim said she was never jealous, explaining that she was not the accused person’s only wife. She stated that the accused has a wife who had a son for him, as she (victim) had sons for him while his the third wife has 5 sons. Elaborating that all the accused does is waste.

Counsel asked the victim that if she was not angry and jealous why would she be bothered with how the accused spends his money and to whom he gave his properties to that the victim replied that it would
bother her because the accused’s first wife died and she (victim) was the one with the first wife’s children along with her own children she expressed that all the accuse does is to lands and waste the money. She stated that the accused sold 4 properties where they were and then another 4 properties in the bush where she is staying at she elaborated that it got to a point where the accused became more popular than the Alkalo.

Counsel asked the victim that if despite the purported selling of lands by the accused of his children ever suffered to that she replied that the accused’s children live in destitute because he had not bought anything for them, she (victim) expressed that she sells charcoal and firewood to support the family.

“Even the house we are in with the children is not properly built. In a way I am the accused person’s sister and because of this reasons the children of my co wife are also my children. My co wife’s children all come to me that was why when the accused said he was going to sell the property that we were occupying I refused but he told me that if I don’t stop telling him that he will kill me. I can even say that he has killed me. I told the court that I don’t want to talk on the matter again because all the children come to me and cry. “ the victim said.

When asked if any of the accused’s children have ever slept on the streets because of the purported selling of the lands by the accused, she replied that none of his children have ever slept on the streets.

That was all defense Counsel O. Susso had for the victim,so State Counsel A.Dibba re-examined the victim by asking her what was the name of the first wife seeing as she had indicated earlier that she is not the first wife of the accused and that she met the accused with a wife before her marriage to the accused to that she replied that the name of the wife was Jarri Jallow.

PW3 (Victim) was discharged and the case was adjourned to the 8th of July at 11am for hearing of PW4.
