Pablo Djabi Submits Medical Report To High Court

Pablo Djabi had submitted his medical report to the High Court in order for the High Court to allow him to travel outside the Gambia due to health issues. As in December 2023, he was restricted from traveling outside the Gambia by Justice Francis .A. Achibonga of the High Court in a ruling where he granted Pablo Djabi bail. Pablo is standing in trail for drug related issues.

Pablo highlighted that he had attached his medical report from Kanifing General Hospital with a Kidney Stone with Hydronephrosis Secondary which required extracorporeal shock wave by the Kanifing General Hospital. Hence he attached a copy of the said Medical Report from Kanifing General Hospital as it is affecting him and his business so he wants the court to intervene.

“Unless this Honourable Court intervenes, my health condition is likely to deteriorate significantly in the future,”he said, adding that “unless this Court intervenes my health condition will also affect my business which will have a great impact on my finances”.

“I have been having pain during the three months I was in custody but had always drank painkillers believing same to be minor. The pain revolves around the abdominal part most times in my left side which has been persistent. After my release, I went to different hospitals for checkups. Due to its persistence, I decided to conduct a general check-up.” Pablo said.

Due to this reasons, Pablo through his lawyer kadijatou Jallow had filed a motion before Justice Jaiteh of the High Court seeking permission for Pablo to be allowed to travel outside the Country for medical purposes. The motion was supported by a statement sworn to by Pablo Djabi.

Pablo Djabi, the resident of Fajara was charged at the Kanifing Magistrates’ Court on the 12th September 2023 with Counts of Conspiracy under the  Drug Control Act and charges under the Anti-Money Laundering and Combating Terrorist Financing Act 2012.

Pablo was granted bail by the Kanifing Magistrates’ on 14th September 2023, but the bill granted by the Magistrates’ Court was stayed by the High Court on 15th September 2023. After an appeal was lodged against the ruling of the Kanifing Magistrates’ Court delivered on the 14th day of  September 2023 and the 15th day of September 2023 in the High court delivered judgment on the Appeal and upheld the Appeal filed against the Ruling of the Kanifing Magistrates’ Court.

Pablo said he afterwards filed an application for bail before the High Court of the Gambia against the charges preferred against him at the Kanifing Magistrates’ Court which was then granted to him on the 6th December 2023 by the High Court. The bail bond was the sum of D120,000,000 with two sureties, to be justified with landed property/properties and for Pablo to deposit his two international passports with the registry of the Court.

“The applicant shall not have access to his international passport except with the leave of court”, Justice Achibonga ruled.

Pablo said he  was released after fulfilling the bail conditions, he was also passed an order that he should report to the Drug Law Enforcement Agency of the Gambia (DLEAG) Headquarters in Pipeline, Kanifing Municipality regularly and punctually every Tuesday of the week at 10am.

Pablo said the High Court has frozen his assets and accounts in the Gambia on the 31st of October 2023. He added that he was in custody for over 3 months with the DLEAG in different places from September to December 2023 when he was granted bail by this Honourable Court. He said he will not abscond since he has been given sufficient bail bond and has a business interest in the Gambia.

The state Prosecutor Lamin Jarju, has indicated that they will oppose the application, the case has been adjourned to the 9th April 2024.
