IGP Vs EMEKA & 3 others

Emeka Anthony, Dominic Osinachi, Paul Ozima Iwu,Ifeanyi Elvis Nwadike appeared yesterday 8th February 2024 at the Magistrate Court before Sallah Mbaye where they are facing 3 Counts before them.

Abdoulie A Danso (PW1), a resident of Kerr Sering and the first prosecution witness was asked by SI Jallow about his whereabouts on the 30th December 2023 to this he explained that he left his house at kerr Sering to go to the GTBank at Senegambia where he withdrew his check of D50,000 then drove back to his house at Kerr Sering in his vehicle a black 190 Mercedes Benz Bjl 7078D upon reaching his house he parked, then went into his compound to collect an invoice of some materials that he had intended to buy.

SI Jallow asked PW1 where was the money and if it was still in the vehicle the time he left and to this he responded that it was wrapped in a brown envelope in his car and when he left the car the money was still in it but upon his return he realized that the door of his driver’s seat was opened and when he placed the key on the door it wasn’t functioning to neither open nor close the door.

PW1 was further asked if the car was locked and he said yes it was locked before he left but upon his return he realized the money was gone along with his wallet. When asked what was in his wallet and how much was the money he replied that the money was D50,000 and in his wallet was his ID, driver’s license,GRA Tin card along with his business card and old business cards.

SI Jallow for the prosecution also asked him what did he do after that, he (PW1) replied that he told someone at the next compound that someone had tampered with his car so he went to the kololi police station from there to file a report after that a number was given to him to call incase he had any suspect.

The accused persons were pointed at for PW1 to identify and SI Jallow asked him if he recognizes the accused persons and from where, he (PW1) replied with a yes he met them before but before that he saw one of them at the Kololi police station. When asked who amongst them did he see at the station he identified Paul as the person he saw at the station that day.

The Prosecution then Applied for an adjournment from the judge which was granted and the matter was adjourned to the 20th February 2024 at 2:30 for continuation of evidence in chief for PW1.

The accused have been charged with three (3) counts of felony and stealing, respectively, contrary to Section 368 and 256 (C) of the Criminal Procedure Code.

The police alleged that Emeka Anthony, Dominic Osinachi, Paul Ozima Iwu, and Ifeayi Elvis Nwadike conspired amongst themselves to commit a felony therein with stealing in Senegambia and diverse places on or about the 30th day of December 2023.

On count 2, the prosecution alleged that the accused attempted to commit a felony contrary to Section 365 of the Criminal Procedure Code by unlawfully attempting to steal D 120,000 (One Hundred and Twenty Thousand Dalasis) from one Sheikh Tijan Touray at Senegambia on or about the 20th day of January 2024.

Furthermore, on count 3, the prosecution alleged that the accused stole from a motor vehicle contrary to Section 265(C) of the Criminal Procedure Code an amount of D50,000.00 Dalasis from marked BENZ 190 Registration Number BJL 7078 on or about the 30th day of December 2023, being the property of one Abdoulie A. Danso.
