Emeka & 3 Others Plead Not Guilty To Charges Before Them

Emeka Anthony, Dominic Osinachi, Paul Ozima Iwu, Ifeanyi Elvis Nwadike appeared today 1st February 2024 at the Magistrate Court before Magistrate Sallah Mbaye where they pleaded not guilty to 3 Counts before them.

The charges put forward to them were conspiracy to commit a felony contrary to Section 368 of the Criminal Code CAP 10:01 VOLUME III laws of the Gambia 2009, attempt to commit felony contrary to Section 365 of the Criminal Code CAP 10 VOL III laws of the Gambia and stealing from a Motor Vehicle contrary to Section 256(C) of the Criminal Code CAP 10 VOL III revised laws of the Gambia. 

The 4 accused when the particulars of offense were read to them as “Emeka Anthony, Dominic Osinachi, Paul Ozima Iwu, Ifeanyi Elvis Nwadike on or about the 30th day of December, 2023 at Senegambia and diverse places in The Republic of The Gambia, you conspire amongst yourselves to commit a felony therein wit stealing, thereby you committed an offense” under count 1which they pleaded not guilty.

Under count 2 the particulars of offense read to them were “Emeka Anthony, Dominic Osinachi, Paul Ozima Iwu, Ifeanyi Elvis Nwadike on or about the 20th day of January 2024, at Senegambia, in The Kanifing Municipality of The Republic of The Gambia, you without lawful authority attempted to commit a felony therein wit, attempts to steal D 120,000 (One Hundred and Twenty Thousand Dalasis) from one Sheik Tijan Touray, thereby committed an offense “which they pleaded not guilty to as well.

Under count 3 particulars of offense were read to them as well “Emeka Anthony, Dominic Osinachi, Paul Ozima Iwu, Ifeanyi Elvis Nwadike on or about the 30th day of December 2023, at Senegambia, in the Kanifing Municipality of The Republic of The Gambia, you stole from a motor vehicle mark BENZ 190 Registration Number BJL 7078 D cash amount of D50,000.00 Dalasis,being the property of one Abdoulie A. Danso, thereby committed an offense” which they also pleaded not guilty.

The prosecution team, Sub-Inspector Cherno Baba Jallow and Cadet inspector E.N Joof applied for adjournment of the case as they further objected to Bail of the accused persons considering that investigations are still on going and expected to conclude in the coming week they asked the court to remand them at the Mile 2 Prisons considering that they are not Gambians but Nigerians and if granted court bail they might leave the jurisdiction of the country. 

The Magistrate having considered what was said by the prosecution and seeing as the accused persons did not object to what the prosecution said granted the adjournment and also ordered for the accused persons to be remanded at the Mile 2 pending the completion of the case.

The case was adjourned to the 8th of February 2024 at 11:30am for hearing.
